Terms of Service
The agreement between you and oonelab INC. for Capture, our photo booth software for Windows.
oonelab INC. Last updated September 19, 2026.
Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and oonelab INC., a corporation incorporated under the Canada Business Corporations Act ("Oonelab", "we", "us", or "our"), governing your access to and use of Capture, the websites and account pages at capture.lerobotbooth.com, and related services (together, the "Service").
Please read these Terms carefully. They include provisions that limit our liability and require you to indemnify us. By installing or using Capture, you agree to them. If you do not agree, do not use the Service.
Definitions
- "Capture" is our photo booth software for Windows.
- "Trial" means Capture used without an activated licence key. It is the complete application and is not time limited, but it applies a watermark to photos.
- "Pro" means Capture with an activated licence key, which removes the watermark.
- "Licence key" means the key we issue to you when you subscribe.
- "Guest" means a person photographed at an event you run using Capture.
Eligibility and accounts
You must be able to form a binding contract to use the Service. The trial needs no account and no licence key. An account is required only to buy and manage a Pro subscription. One LeRobotBooth account signs you in to both Capture and Engage, our live event games service, which is governed by its own terms. You are responsible for keeping your account credentials and your licence key confidential, and for activity under them.
The Service and licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Capture for your own business or personal use. Capture is licensed, not sold. We reserve all rights not expressly granted.
One device per licence. A Pro licence key activates on one computer at a time. You may move it between computers, from your account page or from within Capture itself, up to 10 times in any rolling 30 day period. You may not share your licence key, or use one key to run Capture as Pro on more than one computer at a time.
You may not reverse engineer, decompile, or attempt to circumvent the licensing or watermarking in Capture, or help anyone else do so, except to the extent that restriction is prohibited by applicable law.
Fees, the trial and subscriptions
The trial is free of charge, is not time limited, and applies a watermark to photos. Capture Pro is a subscription, offered monthly or annually at the prices shown at the time of purchase.
Subscriptions renew automatically at the end of each period until cancelled. You authorise us, through our payment processor, to charge your payment method for each renewal. You can cancel at any time from your account page, and you keep Pro until the end of the period you have already paid for. Refunds are governed by our Refund Policy.
If a payment fails, we may mark your licence past due and Capture will return to the watermarked trial until the payment is resolved. Prices may change, and we will give notice before a change applies to your renewal.
Acceptable use
You agree not to use the Service to break the law, to infringe anyone's rights, or to photograph people without whatever notice or consent the law requires where your event is held. You agree not to resell, sublicence, or redistribute Capture or licence keys without our written permission.
Your responsibilities: guests, consent and compliance
You decide what events you run, who you photograph, what you do with the photos, and which storage and AI providers the booth is connected to. We never receive the photos and have no access to them. You are responsible for complying with the privacy, data protection, and image rights laws that apply to you and your events, and for giving your guests whatever notice or obtaining whatever consent those laws require.
Your cameras, storage and AI providers
Capture is designed to run on your hardware with your accounts. Any cloud storage or AI provider you connect is your own service, used under your own agreement with that provider and billed to you by them at their rates. We are not a party to those agreements, we do not receive the media that flows to them, and we do not mark up or resell their usage.
You are responsible for choosing providers appropriate to your event, for the security of the keys you enter, and for complying with those providers' terms and acceptable use policies. If a provider suspends or changes its service, or its prices change, that is between you and them.
AI processing of guests. AI features can process images of the people in front of your booth. You decide whether to enable them. You are responsible for telling guests that AI processing is taking place, for obtaining any consent the law requires where your event is held, including any consent required for biometric or facial data in your jurisdiction, and for honouring requests guests make about their images. We cannot do any of this for you, because we never receive the media.
Licence telemetry
When a licence key is activated, and while it stays active, Capture checks in with us so we can enforce one device per licence and know which version is running. What that check-in contains, and what it does not, is set out in our Privacy Policy. It contains no photos and no guest information.
Intellectual property
Capture, the Service, and all related software, branding, and content are owned by Oonelab or our licensors and are protected by intellectual property laws. These Terms do not transfer any ownership to you. Photos you take with Capture are yours.
Third-party services
We use Stripe to process payments and Google Cloud to run our servers and accounts. Your use of those services through us is also subject to their own terms. We are not responsible for third-party services we do not control.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error free, or compatible with any particular camera, printer, or computer. Nothing here is legal advice.
Limitation of liability
To the fullest extent permitted by law, Oonelab will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, photos, or business, arising out of or relating to the Service, even if we have been advised of the possibility. Our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
Indemnification
You agree to indemnify and hold harmless Oonelab and its directors, officers, and employees from any claims, damages, liabilities, and reasonable legal costs arising out of your use of the Service, your events, the photos you take, or your breach of these Terms or of applicable law.
Suspension and termination
You may stop using the Service at any time and cancel from your account page. We may suspend or revoke a licence key if it is shared or used on more than one computer at a time, if payment fails and is not resolved, if the Service is used in breach of these Terms or the law, or if required by a payment processor or by law. Where it is reasonable to do so, we will contact you first. A revoked key stops working on the next licence check.
Changes to the Service or Terms
We may change the Service and these Terms from time to time. The "Last updated" date reflects the current version. If a change materially affects your rights, we will give reasonable notice. Continuing to use the Service after a change takes effect means you accept the updated Terms.
Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules. You and Oonelab submit to the exclusive jurisdiction of the courts of Ontario, Canada, subject to any non-waivable rights you have under the consumer protection laws of your own jurisdiction.
General
If any provision of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the Service.
